Amway settles $225M FTC claims

Amway and Affiliates Settle $225 Million FTC Lawsuit Over Earnings Claims

In a major legal resolution, Amway, along with two of its affiliates, has agreed to a substantial US$225 million settlement with the US Federal Trade Commission (FTC). This agreement addresses serious allegations concerning earnings claims made to independent distributors and the reporting of product sales within the direct-selling structure.

The core of the FTC’s complaint centered on misleading representations made to prospective Independent Business Owners (IBOs) regarding potential income. The agency alleged that the company made claims suggesting participants could earn more than US$40,000 annually or replace their full-time income. Furthermore, the FTC asserted that many participants joining the organization after 2020 spent more on Amway products and training than they actually received in return from the company.

The settlement is designed to provide restitution, with nearly the entire amount expected to be distributed to the affected participants. Beyond the financial component, the agreement mandates significant changes to Amway’s operational and compliance practices in the United States. These requirements are intended to fundamentally alter how the direct-selling model is conducted.

A key requirement introduced by the settlement involves changes to distributor inventory and retail sales verification. Specifically, the agreement requires IBOs to sell at least 70 percent of the products purchased from Amway each month to other customers. This mandate aims to ensure that sales are genuinely reflective of retail activity rather than solely internal consumption.

Amway has voiced its dispute regarding the FTC’s characterization of its business operations and its assertion that the company’s sales data was inaccurate. While the settlement resolves the immediate legal challenge, the implications for Amway‘s business practices and compliance framework remain a significant point of focus.

Ultimately, this settlement introduces major operational and compliance shifts for Amway‘s direct-selling model in the US, focusing on transparency, earnings representation, and the verification of retail sales for all participants.
